Terms of Use

1. Purpose

Fluxer is operated by HOVER FOCUS, a French SASU registered with the Versailles Trade and Companies Register under SIREN 948 883 582, with registered office at 10 RUE AU PAIN, 78000 VERSAILLES, France.

Fluxer provides iOS, iPadOS, macOS, and tvOS apps available through the App Store. The apps let users import, organize, and play IPTV playlists provided by the user. The getfluxer.app website presents the product and provides account, support, and legal information pages.

2. User account

Some features may require an account. You must provide accurate information, keep credentials confidential, and report unauthorized use. Fluxer may suspend access in case of abuse, fraud, or violation of these terms.

You are responsible for activity performed through your account unless the activity results from Fluxer's own breach of security obligations.

3. Third-party content and sources

Fluxer does not sell, provide, or control any IPTV stream, channel, movie, series, subscription, or third-party audiovisual content. You are solely responsible for playlists, URLs, credentials, and content you add to the app, as well as compliance with applicable rights.

Fluxer is a neutral streaming player. Users are solely responsible for ensuring they have legal rights to access content from their configured sources.

4. Authorized use

You agree not to use Fluxer to:

• access content without authorization or in violation of the law;
• circumvent security, digital rights, or access control measures;
• disrupt Fluxer's infrastructure, APIs, accounts, or associated services;
• resell, copy, or modify Fluxer without authorization.

5. Availability

Fluxer is provided on a reasonable-efforts basis. Some features depend on third-party services, your connection, your IPTV sources, and technical platform availability. Interruptions, changes, or maintenance may occur.

Fluxer may modify, suspend, or discontinue features when necessary for maintenance, security, compliance, or product evolution.

6. Intellectual property

Fluxer, its name, logo, interface, code, and owned content are protected by applicable intellectual property rights. Third-party content accessible through your sources remains the property of its respective rights holders.

7. Personal data

Personal data processing is described in the Privacy Policy. By using Fluxer, you acknowledge that you have read that policy.

8. App Store terms

For Fluxer apps distributed through the App Store, these terms are agreed between you and HOVER FOCUS, not Apple. Apple is not a party to these terms.

HOVER FOCUS grants you a personal, non-transferable license to use the Fluxer app on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and the App Store usage rules.

HOVER FOCUS is responsible for the app and for any maintenance and support services. Apple has no obligation to provide maintenance or support for Fluxer.

If Fluxer fails to conform to an applicable warranty and the app was purchased through the App Store, you may notify Apple, and Apple may refund the purchase price according to its rules. To the maximum extent permitted by law, Apple has no other warranty obligation for Fluxer.

HOVER FOCUS, not Apple, is responsible for addressing claims relating to Fluxer, including product liability claims, legal or regulatory compliance claims, consumer protection claims, privacy claims, and claims that the app infringes a third party's intellectual property rights.

You represent that you are not located in a country or region subject to a United States government embargo or designated by the United States government as a terrorist-supporting country, and that you are not listed on any United States government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.

If paid features, subscriptions, or in-app purchases are offered, purchase processing, renewal, cancellation, and refunds are handled through Apple and your App Store account according to Apple's applicable terms.

9. Termination

You may stop using Fluxer at any time and may request account deletion when account features are enabled. Fluxer may suspend or terminate access if you materially breach these terms, misuse the service, or create legal, security, or operational risk.

10. Liability

To the extent permitted by law, Fluxer is not liable for third-party content, services, or providers, playlist availability, or consequences of use that violates these terms.

Nothing in these terms excludes liability that cannot be excluded under applicable law.

11. Changes to terms

These terms may be updated to reflect product changes, legal obligations, or service organization. The update date at the top identifies the applicable version.

12. Governing law

Unless mandatory consumer protection rules require otherwise, these terms are intended to be governed by French law. Any competent court will be determined under applicable procedural and consumer protection rules.
